The utilization of the dae-hq.dk website and its associated domains, webpages, subdomains, and components (collectively referred to as the "WEBSITE") is governed by the following terms and conditions (referred to as "TOS"). All services accessible through the WEBSITE are rendered by DAE.

The WEBSITE, along with its services (referred to as the "SERVICES"), are extended to you on the condition that you accept, without alteration, all the terms and conditions delineated herein, as well as any additional operational regulations, policies, and procedures that may be periodically published on the WEBSITE by DAE (collectively termed as "THE AGREEMENT").

By accessing any portion of the WEBSITE or using its SERVICES, you consent to be bound by the entirety of the terms and conditions outlined in this agreement. Failure to agree to all the terms and conditions specified in this agreement prohibits you from accessing the WEBSITE or utilizing any of its SERVICES.

DAE facilitates the procurement of event tickets and related airsoft equipment. Payments are processed through Nets (referred to as "Facilitated Payment Mode" or "FPM").

When shopping at DAE, using our Internetshop, you must accept that a final buying agreement will not be made before a crew from the association have processed your order. DAE reserves its right to cancel an order, due to soldout products, wrong pricing, products not available, risk of credit card fraud or in other cases.

Modification of These Terms

DAE retains the authority, at its exclusive discretion, to amend or substitute any segment of this TOS whenever deemed necessary. It is incumbent upon you to regularly review this TOS for any alterations. Your ongoing utilization of or access to the WEBSITE subsequent to the publication of any modifications to this TOS implies your acknowledgment of those changes. Should any modification to this TOS be unacceptable to you, it is imperative that you discontinue accessing the WEBSITE and its SERVICES.

Conduct

Your use of the SERVICES

DAE hereby provides you with a non-exclusive, non-transferable, non-sublicensable privilege to access and utilize the SERVICES exclusively for the purpose of purchasing event tickets and managing your tickets and associated information, all in accordance with the TOS.

You are prohibited from:

- Attempting to reverse engineer, disassemble, decompile, or otherwise uncover the source code or structure of any portion of the SERVICES.

- Altering or removing any proprietary notices or labels present on or within the SERVICES or WEBSITE content.

- Participating in any actions that disrupt or interfere with the SERVICES, or engaging in fraudulent activities or activities that facilitate fraud.

Your Registration Obligations

Upon registering an account on the WEBSITE, you commit to:

- Furnishing truthful, precise, up-to-date, and comprehensive information about yourself as prompted by the WEBSITE registration form (referred to as the "REGISTRATION DATA").

- Ensuring the continuous accuracy, currency, and completeness of the REGISTRATION DATA by promptly updating it as necessary.

Your Account Security

Upon registering an account on the WEBSITE, you assume full responsibility for safeguarding the security and confidentiality of your account. You are wholly accountable for all activities conducted under your account, including, but not limited to, any actions undertaken by sub-users granted access to your account. You undertake to promptly inform DAE of any unauthorized access to your account. DAE shall not be held liable for any losses, damages, or other liabilities stemming from your non-compliance with this section of the TOS or from any unauthorized access to or utilization of your account.

Your Content

If you choose to upload any links, videos, audio files, photographs, graphics, or computer software ("CONTENT") to the WEBSITE, you grant DAE a non-exclusive, worldwide, royalty-free, transferable, sublicensable right to utilize, reproduce, adapt, modify, distribute, translate, and publish your CONTENT, either in its entirety or in part, for any purpose whatsoever.

You bear full responsibility for your CONTENT and any resulting harm. By making your CONTENT accessible through the SERVICES, you agree not to:

- Upload, post, email, transmit, or otherwise make available any CONTENT that is unlawful, harmful, threatening, abusive, harassing, pornographic, tortuous, defamatory, vulgar, obscene, libelous, racist, or invasive of another person’s privacy.

- Share any CONTENT that infringes upon any patent, trademark, copyright, trade secret, or any other intellectual property or proprietary rights of any individual or organization.

- Upload, post, email, transmit, or install any malicious software, such as worms, malware, spyware, Trojan horses, or any other harmful or destructive content.

- Disrupt or interfere with the SERVICES, or with services or networks connected to the SERVICES.

- Utilize an account name that misleads your customers or potential customers into believing that you are another person or company.

DAE shall not be held liable for any loss, damage, or harm arising from the posting of your CONTENT. DAE reserves the right, at its sole discretion, to reject or remove any content that, in DAE's reasonable opinion, violates any DAE policy or is harmful in any manner. DAE also reserves the right to terminate or deny access to the WEBSITE and/or SERVICES to any individual or organization, for any reason, at DAE's sole discretion.

Site Content

DAE has not undertaken a comprehensive review of all materials posted on the WEBSITE and therefore cannot guarantee the accuracy or endorse the content therein. It is your responsibility to safeguard yourself and your computer against potential threats such as worms, malware, spyware, Trojan horses, or any other harmful content.

The WEBSITE may feature content that is unlawful, harmful, threatening, abusive, harassing, pornographic, tortuous, defamatory, vulgar, obscene, libelous, racist, or invasive of another person’s privacy, as well as technical inaccuracies, typographical errors, and other mistakes. DAE has not reviewed and cannot assess the entirety of the content available on third-party websites linked to from the WEBSITE. DAE lacks control over the content on websites other than the WEBSITE.

DAE assumes no responsibility for any harm, loss, or damage resulting from CONTENT posted on the WEBSITE, available through the SERVICES, or found on third-party websites not affiliated with the WEBSITE.

Personal Data

DAE bears no responsibility for any harm, loss, or damage incurred due to your or any other user's violation of the General Data Protection Regulation (GDPR).

Payment

When utilizing FPM, users conduct monetary transactions through the FPM service and are subject to the relevant terms of use associated with the FPM service.

DAE assumes no liability for any harm, loss, or damage resulting from the use of third-party FPM services.

Termination

DAE reserves the right, at its sole discretion, to immediately terminate access to your account, accounts, or any aspect of the SERVICES, with or without cause, and with or without prior notice. Additionally, DAE may delete and discard all of your CONTENT within the SERVICES at any time, for any reason or no reason at all. Should you choose to terminate this AGREEMENT, you must cease using this WEBSITE.

All clauses within this TOS that inherently extend beyond the termination of your right to use the SERVICES shall continue in effect after termination. These include, but are not limited to, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Service Modifications

DAE retains the authority to modify, suspend, or terminate, either temporarily or permanently, the SERVICES or any portion thereof, at any time and for any reason, or without reason, with or without prior notice. You acknowledge that Berget Events shall bear no liability to you or any third party for any such modification, suspension, or discontinuation of the SERVICES.

Intellectual Property

This AGREEMENT does not entail the transfer of any DAE or third-party intellectual property rights to you, and all rights to such property will exclusively remain with DAE.

Trademarks

DAE are registered trademarks owned by DAE. Other trademarks, service marks, graphics, and logos used in association with the WEBSITE may belong to third parties. Your use of the WEBSITE does not grant you any rights or licenses to reproduce or utilize any DAE or third-party trademarks.

Disclaimer of Warranties

All SERVICES are offered on an "AS IS" basis. DAE explicitly disclaims all warranties, whether express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. DAE does not warrant that the WEBSITE or SERVICES will be free of errors, or that access to the SERVICES will be continuous or uninterrupted. Any content or services obtained through the WEBSITE are at your own discretion and risk.

Limitation of Liability

Under no circumstances shall DAE and its suppliers or licensors be liable for any aspect of this AGREEMENT, including but not limited to, any special, indirect, incidental, consequential, punitive, or exemplary damages arising from circumstances such as contract breaches, negligence, strict liability, or other legal theories. These damages may include, but are not limited to, loss of profits, goodwill, use, data, or other intangible losses.

Furthermore, DAE and its suppliers or licensors shall not be liable for:

- The cost of acquiring substitute products or services,

- Interruption or discontinuation of use,

- Loss of or corruption of data, or

- Any matters beyond DAE's reasonable control.

This limitation of liability extends to your CONTENT or the CONTENT of any other users of the SERVICES.

Indemnity

You agree to protect, indemnify, and hold harmless DAE and its affiliates, suppliers, contractors, licensors, as well as their respective directors, officers, employees, agents, and other partners, from and against all claims and expenses, including attorneys' fees and accounting fees, arising from your use of the WEBSITE. This includes, but is not limited to, any violation of this AGREEMENT by you.
